Act 165,
enacted by the Vermont Legislature in 1996 requires that all rental
properties and Child Care Facilities built prior to 1978 take steps
to help prevent children from being exposed to lead. Property owners
must make sure that anyone who performs essential maintenance work
on the property does the work correctly and has completed a training
program or is supervised on-site by someone who has completed the
training program. Owners need to sign an affidavit stating that
essential maintenance has been carried out and file it yearly with
their insurance carrier and the Vermont Department of Health.
The
City of Winooski requires that all rental dwelling units and Child
Care Facilities have a “Certificate of Compliance” prior to
occupancy. The Minimum Housing Standards inspection conducted by the
City requires proof that essential lead maintenance practices were
performed prior to issuance of the certificate. Evidence of high
lead levels will be cited as a health violation in Winooski's
inspection report.
